    The NLRB's Expanding Agenda - 2014 Update

    Speaker: Brian Mumaugh, Partner at Holland & Hart, LLP

     

    Speaker Profile: Brian works with employers in a wide range of industries to effectively manage their employees and resolve employment disputes. A graduate of Creighton University School of Law with over 25 years of experience, clients trust him to find practical, favorable solutions to their labor and employment issues. In addition to representing companies in federal and state courts in multiple states across the country, Brian also represents employers before Federal and State Administrative agencies including the EEOC, the NLRB, the NMB, U.S. Department of Labor, the Colorado Civil Rights Commission, and the Colorado Department of Labor. Brian has comprehensive experience representing management in labor matters including representation elections and disputes, unfair labor practice proceedings, unit determinations,  and collective bargaining. His nationwide practice in traditional labor law includes labor negotiations, arbitrations, litigation and contract interpretation across a variety of industries, such as manufacturing, transportation, airlines, railroads, mining, construction, warehousing, medical, grocery, and security and government contracting. Prior to joining Holland & Hart in 1989, Brian served as in-house labor attorney representing a major airline in labor matters, arbitrations, collective bargaining and providing advice to management on a wide variety of labor and employment issues.

    Presentation Overview:  Overview of the National Labor Relations Act and the role of the National Labor Relations Board, including discussion of significant U.S. Supreme Court cases in its 2013-2014 term affecting labor and the NLRB.  We will also provide updates on recent NLRB developments to include use of employer email for union organizing, the “quickie/ambush” election rule, the NLRB’s Employee Rights Poster and the status of the Employee Free Choice Act, and discussion of the NLRB’s attack on employer policies. Examples will be provided of cases in which the NLRB is extending what constitutes protected concerted activity.  In addition, Tips will be provided for employers who wish to stay union free.

    Attendees will learn what the National Labor Relations Act is, how it applies to their company and how the NLRB can shape labor laws; what the Noel Canning decision means for certain NLRB decisions and actions; what the Harris v. Quinn decision signals for unions and the future of union dues and fees; how employers will be affected by the proposed quickie election rule and possible overruling of the Register Guard case regarding the use of employer email in union organizing; how employers should identify employment policies that may be subject to NLRB attack and how to revise them to make them less restrictive on employee protected activity rights; steps that employers can take to help maintain a union-free workplace.

    **NOTE**

    This program has been approved for 1.0  (HR (General)) recertification credit hours toward PHR, SPHR or GPHR recertification through the HR Certification Institute.
